1.            Acknowledgement and Acceptance of Terms
FFO LLC dba Interactive Mindfulness Initiative (“Organization”) is committed to protecting your privacy. This Website Privacy Policy (“Privacy Policy”) sets forth our current privacy practices concerning the information we collect when you or your computer interacts with our website. By accessing MindfulMovement.org, you acknowledge and fully understand the Organization’s Privacy Policy and freely consent to the information collection and use practices described in this Privacy Policy.

 

2.            Participating Merchant Policies
Related services and offerings with links from this website, including vendor sites, have their own privacy policies that can be viewed by clicking on the corresponding links within each respective website. Online merchants and others who participate in the Organization services are encouraged to participate in industry privacy initiatives and to take a responsible attitude towards consumer privacy. However, since we do not have direct control over the policies or practices of participating merchants and other third parties, we are not responsible for the privacy practices or contents of those sites. We recommend and encourage that you always review the privacy policies of merchants and other third parties before you provide any personal information or complete any transaction with such parties.

 

3.            Information We Collect and How We Use It
The Organization collects certain information from and about its users in three ways: directly from our Web Server logs, Cookies, the user, including in response to surveys and questionnaires, and content voluntarily shared in forums.

o        Web Server Logs
When you visit our Website, we may track information to administer the site and analyze its usage. Examples of information we may track include:

  • Your Internet protocol address.

  • The kind of browser or computer you use.

  • Number of links you click within the site.

  • State or country from which you accessed the site.

  • Date and time of your visit.

  • Name of your Internet service provider.

o        Use of Cookies
The Organization may use cookies to personalize or enhance your user experience. A cookie is a small text file placed on your hard disk by a Web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a Web Server in the domain that issued the cookie.

One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page or navigate within a site, a cookie helps the site recall your specific information on subsequent visits. Hence, this simplifies the process of delivering relevant content and eases site navigation by providing and saving your preferences and login information and providing personalized functionality.

The Organization reserves the right to share aggregated site statistics with partner companies but does not allow other companies to place cookies on our website unless there is a temporary, overriding customer value.

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. If you reject cookies by changing your browser settings then be aware that this may disable some of the functionality on our Website.

o        Personal Information of Users
Visitors to our website may be permitted to register for certain services, such as emails and texts. When you register, we will request personal information such as name, address, email, telephone number, account number, and/or  other relevant information.

We will not disclose personally identifiable information we collect from you to third parties without your permission except to the extent necessary, including:

  • To protect ourselves, our customers, or our vendors from liability or to defend our rights, including investigations of fraud or misconduct

  • In connection with a merger, acquisition, or liquidation of the Organization.

4.            Use of Web Beacons or GIF files
Organization Web pages may contain electronic images known as Web beacons – sometimes also called single-pixel gifs – that allow the Organization to count users who have visited those pages and to deliver co-branded services. The Organization may include Web beacons in promotional e-mail messages or newsletters to determine whether messages have been opened and acted upon.

Third-party service providers may place some of these Web beacons to help determine the effectiveness of our advertising campaigns or email communications. These service providers may use these Web beacons to place a persistent cookie on your computer. This allows the service provider to recognize your computer each time you visit certain pages or emails and compile anonymous information in relation to those page views, which in turn enables us and our service providers to learn which advertisements and emails bring you to our website and how you use the site. The Organization prohibits Web beacons from being used to collect or access your personal information.

We have not implemented any technology that would effectively recognize do not track signals and note that some content available on our Site is made available through relationships with third party providers who we do not control and who may have collect and/or disclose personally identifiable information.

We use commercially reasonable procedures to protect the personal information we collect from you against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction. We have developed and implemented and continue to maintain and monitor a written information security program applicable to all records containing personal information. This security program is appropriate to the size, scope, and type of our business, the resources available to us, the amount of stored data, and the need for security and confidentiality of the personal information we store. No security system is impenetrable. We cannot guarantee the security of our databases or the security of the information you supply to us during transmission over the Internet. You can help us by taking precautions to protect your personal information when you are on the Internet and only disclose information that you want made public. Change your passwords often using a combination of letters and numbers and make sure to use a secure web browser.

For the purposes set out in this Privacy Policy, personal information may be transferred to, processed, stored, and accessed by us, our affiliates, and third parties in the United States and in other jurisdictions where we or they operate. From time to time, Organization may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from Organization or click on a link therein. If you would like to stop receiving marketing or promotional communications via email from Organization, you may opt out of such communications by contacting us or selecting an “unsubscribe” option from email

 

11.       SMS Communications

Agreement to Receive Text Messages: By providing your mobile number, you agree that Organization may send you periodic SMS or MMS messages containing but not limited to important information, updates, deals, and specials. You will receive up to 4 messages per month. You may unsubscribe at any time by texting the word STOP back to us. You may receive a subsequent message confirming your opt-out request. For help, send the word HELP back to us. Message and data rates may apply. United States Participating Carriers Include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile and others. T-Mobile is not liable for delayed or undelivered messages. You agree to notify us of any changes to your mobile number and update your account with us to reflect this change. Data obtained from you in connection with this SMS service may include your cell phone number, your carrier’s name, and the date, time and content of your messages, as well as other information that you provide. We may use this information to contact you and to provide the services you request from us. By subscribing or otherwise using the service, you acknowledge and agree that we will have the right to change and/or terminate the service at any time, with or without cause and/or advance notice. Though Organization will never charge you for the text messages you receive, depending on your phone plan, you may see some charges from your mobile provider. Please reach out to your wireless provider if you have questions about your text or data plan.

Children Under 13
We do not specifically market to or knowingly collect personal information from children under 13 for marketing purposes. Because some information is collected online, it may not appear to be the personal information of a child under 13. If a child under 13 submits personal information to us and we learn that the personal information is the information of a child under 13, we will attempt to delete the information as soon as possible. If you are under 13, please do not register for our services or provide us with any information about yourself (such as your name, email address, or phone number).

As required by the California Online Privacy Protection Act (“California Act”) and the California Business and Professions Code, this Privacy Policy identifies the categories of personally identifiable information that we collect through our website about individual consumers who use or visit our website and the categories of third-party persons or entities with whom such personally identifiable information may be shared.

13.                  Right to Deletion

You agree that the Organization may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site at any time, for any reason or no reason. You also agree that any violation by you of these Terms will constitute an unlawful and unfair business practice and will cause irreparable harm to Organization for which monetary damages would be inadequate. You consent to the Organization obtaining any injunctive or equitable relief that the Organization deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies the Organization may have at law or in equity.

 

If the Organization does take any legal action against you as a result of your violation of these Terms, the Organization will be entitled to recover from you, and you agree to pay all reasonable attorneys’ fees and costs of such action in addition to any other relief granted to Organization. You agree that the Organization will not be liable to you or any third party for termination of your access to the Site as a result of any violation of these Terms.

 

Governing Law

These Terms are entered into in the State of California and shall be governed by and construed in accordance with the laws of the State of California, exclusive of its choice of law rules that would give rise to the application of the substantive law of another jurisdiction. Each party to these Terms submits to the exclusive jurisdiction of the state and federal courts sitting in Los Angeles County in the State of California and waives any jurisdictional, venue, or inconvenience forum objections to such courts. In the event that any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, those provisions shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

 

Notification of Claimed Copyright Infringement

The Organization respects and expects its users to respect the rights of copyright holders. On notice, the Organization will act appropriately to remove content that infringes the copyright rights of others. If it is believed that any content uploaded infringes upon existing copyrights, owners or any agent may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing us with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail): (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing or to be the subject of infringing activity sufficient to permit Organization to locate the material; (d) information reasonably sufficient to permit Organization to contact you, such as an address, telephone number, and, if available, an electronic mail; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Void Where Prohibited

Organization reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product, or service to any person or geographic area.
